According to DOT HAZMAT regulations, anyone involved in the packaging, marking, labeling, and transporting of hazardous materials must be familiar with proper handling and safeguarding as prescribed in the Hazardous Materials Regulations (HMR).
Case Study: On July 1, 2009, a cargo tank truck carrying 2,999 gallons of gasoline was hit by an automobile. The automobile driver failed to obey a stop sign and collided with the truck. Two of the truck's loading lines were ruptured, releasing approximately 13 gallons of gasoline onto the automobile, which was wedged under the truck. The post-crash fire consumed the automobile, killed the automobile driver, and damaged the cargo tank truck. The self-closing stop valve on the cargo tank functioned properly, and the 2,999 gallons of fuel still contained in the compartment prior to the accident were safely offloaded after the fire was extinguished. The incident report and subsequent investigation resulted in a recommendation to the PHMSA to prohibit flammable liquids from being transported in unprotected external piping "wet lines" on cargo tank trucks. Although the recommendation did not make it into the HMR, PHMSA is conducting a review of incident reports to determine whether changes to the HMR are necessary.

Governing Regulations
Title 49, Code of Federal Regulations (CFR), Parts 100 through 185, govern the transportation of hazardous materials. The Hazardous Materials Regulations (HMR) are found in Parts 171 through 180. The HMR set forth standards for classification, packaging, hazard communication, emergency response information, training of HAZMAT employees, transportation, incident reporting, and security.
DOT is responsible for developing and issuing the HMR. The regulations govern the transportation of hazardous materials in interstate, intrastate, and foreign commerce. DOT carries out this responsibility through the Pipeline and Hazardous Materials Safety Administration (PHMSA). Authority to enforce the HMR is delegated to various agencies within DOT, including PHMSA, FMCSA, FAA, and FRA, as well as the U.S. Coast Guard.
All HAZMAT employees who perform work functions subject to the Hazardous Materials Regulations must be trained in accordance with the HMR. The specific areas of training that must be addressed include the following:

All HAZMAT employees who perform work functions subject to the Hazardous Materials Regulations must be trained in accordance with 49 CFR Part 172, Subpart H, of the HMR. Once initial training has been completed, the HAZMAT employee must go through recurrent training at least once every three years. Air carrier employees must be retrained at least every two years. Unless which there is a change in the working environment, an accident occurs or any other situation arises that earlier re-training may be required.
