Case Study: A construction worker was killed when he fell approximately 12 feet (3.7 meters) through a skylight onto concrete below. The worker was removing roofing materials from a florist shop when he reportedly lost his balance and fell backwards through one of six unguarded skylights. Employees inside the florist shop immediately contacted emergency services, and the worker was rushed to the hospital. He died the next day due to injuries sustained during the fall. It was later discovered that none of the workers on site had received fall protection training and no fall protection equipment was provided. The accident investigators attributed the accident to site management's failure to conduct a site inspection to identify hazards, as well as failure to manage risks prior to beginning work.

Governing Regulations

There are 14 jurisdictions in Canada - 1 federal, 10 provincial, and 3 territorial. Each jurisdiction has its own health and safety legislation. The Canada Occupational Health and Safety (OHS) Regulations are the federal legislation enabled by the Canada Labour Code. Fall protection is covered in OHS Part 12 - Protection Equipment and Other Preventive Measures. OHS has also created the Occupational Health and Safety Act 2004 (OHS Act), which is a document that outlines workers' rights and responsibilities, including the right to stop work that is deemed hazardous or unsafe. OHS also lists the penalties and enforcement techniques to be used if these guidelines are not followed.

To supplement the overarching regulations created by OHS, individual provinces and territories often set their own regulations (in accordance with federal bodies) specific to their needs. Before implementing a fall protection certification program, ensure that you are familiar with the regulations specific to your province or territory.

Employers are responsible for training new personnel before assigning them to tasks that may expose them to working from heights. According to OHS Part 12, employees working from elevated heights must receive initial and refresher fall protection training.

To ensure compliance with OHS safety training standards, retraining must be conducted when changes at the worksite present new hazards, changes in the type of equipment present new hazards, and when inadequacies in an affected employee's work indicate the need for additional training. This online certification meets these training requirements.
